In the last several years there have been more and more cases where substantial verdicts awarded against self-storage facilities, aimly for wronful sale.  Operators have made relatively simple mistakes that in some cases have cost millions of dollars.

The problem is, as Jeffrey will explain, sometimes you are intentionally set up to fail by your tenants, sometimes a simple misunderstanding about the lien sale statute or a technical error in a notice is enough to cause huge legal liability.  Other times it is simply a mistake you make in preparing, the sending notice of, or advertising your lien sale.  Nevertheless, operators are not being shown any mercy by courts and juries.  You simply cannot go to sale anymore without a solid plan and an even better understanding of the requirements of your Statute and clearly mistakes made because you have “always done it that way,” cannot happen in this legal environment anymore.
