Tennessee Lien Law - Updated July 2020



2020 -

SB 543/HB 1073 was passed in the General Assembly and was signed into law effective July 1, 2020

Though auctions will still need to be advertised, the new law allows the storage facility owner to advertise any sale of a tenant's personal property in a commercially reasonable manner. The new law recognizes that public notice to drive bidders to a sale now occurs from online auction sites, social media and from the use of the storage facility mailing lists. Of course, newspaper advertising would still be permissible, but the new law update removes the mandate of the old law that required the use of newspaper advertising.

2017 -

2011 -

Legislation initiated by the Tennessee Self Storage Association - SB 1293 (Southerland) and HB 1265 Sargent) - passed through both the House and Senate and was signed into law by Governor Bill Haslam on April 29, 2011. 

The new law took effect on July1, 2011.  PUBLIC CHAPTER NO. 131 

Attorney Scott Zucker revised the TNSSA base lease agreement in 2020 for TNSSA and its members to comply with recent updates.
